What causes brain injuries?
Brain injury is caused by force sufficient to produce tearing or bruising of brain tissue. Closed head injury results from acceleration-deceleration forces that occur when the person’s head strikes a hard object. But the injury can also occur without the person’s head hitting a hard object, when brain tissue is sheared by hitting bony prominences inside the skull or when the brain twists inside the skull as a result of rapid movement.
Under what circumstances can I file a brain injury claim?
Brain injury claims can be filed when the action causing the injury was the result of carelessness or negligence of another. Many traumatic brain injuries are caused by medical malpractice, motor vehicle accidents, defective products, birth injuries, construction accidents, diving and other sports-related accidents caused by negligence or carelessness. Sometimes, a person involved in incidents like these doesn’t even know there has been a brain injury. Family members observe that the individual was “different” after the accident. Careful examination of the victim and the family may reveal signs of brain injury such as cognitive changes, emotional changes, and physical problems.
