What is medical malpractice?

Essentially, medical malpractice is when a medical professional or institution, such as a physician, hospital, nurse, physical therapist, clinic, or psychiatrist, fails to render the appropriate standard of care to a patient, causing injury, illness, or death. There are usually four elements to filing a successful medical negligence claim. The first is the existence of a duty implied through the doctor-patient relationship; the second is the standard of care, and the failure to apply that standard during treatment (or the breach of the duty owed the patient); a clear cause-and-effect relationship between the failure to administer the correct care and the injury to the patient; and the existence of an injury to the patient.

What can a medical malpractice lawyer do?

Medical malpractice claims are difficult and complex. Expert testimony is required to establish the negligence or carelessness of the medical professional or institution. Experts are also necessary to establish what should have been the appropriate care in an individual case. There are damages caps and time limitations on filing medical malpractice claims. Because of the complexity, it may not be appropriate to spend the time and money on a minor and easily addressed injury. A knowledgeable medical negligence attorney can help you decide if you have the basis for a medical malpractice claim, and explain the process to you.
